Any dispute, claim, or controversy arising out of or relating to this SMS messaging program shall be resolved by binding arbitration governed by the Federal Arbitration Act and administered under the American Arbitration Association (AAA) Consumer Arbitration Rules. By agreeing to these Terms, you waive the right to a jury trial or to participate in a class action.

You may still bring claims in small claims court or before appropriate regulatory agencies. Before initiating arbitration, you must provide written notice of the dispute to Thirteenth Floor Entertainment Group and allow thirty (30) days to attempt informal resolution.

For claims of $15,000 or less, you may elect to have arbitration conducted by document submission, telephone, or in person. Allocation of arbitration fees will be governed by AAA rules.

Arbitration proceedings will remain confidential, and the arbitrator’s decision will be final and binding.
